ACCEPTABLE USE POLICIES (AUP)
1. RioLink Ltd., Co. service is provided on an "as is" basis, and its management disclaims all warranties, express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
2. RioLink Ltd., Co. exercises no control over the content of the information passing through its networks and servers. Use of any information obtained from RioLink Ltd., Co. or through its networks or servers is entirely at users own risk. RioLink Ltd., Co. makes no warranties and accepts no responsibility for the accuracy or quality of such information. RioLink Ltd., Co. will not be responsible for any damage, including direct, indirect, consequential or incidental, that is incurred or suffered. This includes but is not limited to, loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions caused by its own negligence or others omissions or errors. User agrees to indemnify and hold harmless RioLink Ltd., Co. for any damages that may occur to user or other party as a result of the use of RioLink Ltd., Co. services.
3. Use of RioLink Ltd., Co. services may be used for lawful purposes only. Use of RioLink Ltd., Co. services in violation of any applicable federal, state, or local law or regulation is prohibited.
4. User is responsible for obtaining, providing, and maintaining all hardware and software necessary to access the services provided by RioLink Ltd., Co. User agrees that RioLink Ltd., Co. provides temporary storage of data. User is responsible for providing own archival storage of data, and RioLink Ltd., Co. shall have no responsibility for failure to backup or loss of user data. User data may only be stored in the users home directory. RioLink Ltd., Co. reserves the right to limit the amount of data, stored by user in temporary storage and the right to change that limit on notification of user. All users will be provided with a minimum of 24 hour notice if limit is exceeded, prior to possible deletion of excessively large files by RioLink Ltd., Co.
5. A personal account entitles only the named user and members of the same household living at the same address to establish a dial-up connection, and only on one dial-up connection at a time. Multiple individuals accessing a personal account or commercial activities within a personal account are prohibited. RioLink Ltd., Co. reserves the right to determine what is considered commercial web marketing and sales. User agrees the resale of RioLink Ltd., Co. networks and/or services is not permitted. Background processes, any type of IRC BOT, or use of distribution lists in electronic mail or other mass electronic mailing are prohibited. RioLink Ltd., Co. reserves the right to immediately terminate services to any user determined to be sending Unsolicited Commercial Email (UCE) (commonly known as "spam") to others. Whether by use of mass email or individual occasional means, sending of UCE from the RioLink system is strictly prohibited. Termination of service may also result if user fails to cease other forms of email abuse notified of by RioLink Ltd., Co.
6. The monthly billing cycle begins on the 1st day of the month. For accounts not activated on the 1st of the month, charges will be prorated for the 1st month of service. Invoices for service are submitted monthly in advance, and charges will accrue until notification by user of account termination. Regardless of requested termination date, accounts may not be terminated until the end of the current month. Invoices are processed on the 1st of the month and payment is due upon receipt for current monthly fees and all additional charges incurred during the previous month. Accounts are delinquent if account balance is not paid in full by the 15th of the month. Access to service may be denied for any delinquent account, and a $10 service charge may be assessed to reinstate service.
7. RioLink Ltd., Co. reserves the right to modify this document as it deems necessary without permission or consent of its network users, and the current AUP will remain available online to all users via the network. Use of RioLink Ltd., Co. services constitutes acceptance of all terms and conditions of the AUP.
